ScarceHost's Terms of Service
By using our services, you agree to:
1. Legal binding User Agreement
When you accept our User Agreement, you agree to be the first party to the User Agreement, which means that you must follow your part of the User Agreement and we agree to be the second party of the User Agreement, which means that we must also follow our part of the User Agreement.
When you register on our website, you agree that you are 13 years or older (or have parental permission), accept the privacy policy, and agree to follow our User Agreement to avoid termination. Once you adhere to our User Agreement, you must follow it until it is cancelled, deleted, or notified in writing that you no wish to have all information withdrawn.
We have the right to suspend, terminate and take other actions on your account and services if you do not comply with our User Agreement (including Privacy Policy, Cookie Policy, and Refund Policy).
We have the right to cancel the consent of your User Agreement (deleting the account and services) at any time if we think we should do so. If it happens, we may reimburse you for the amount paid for the active services you are currently using.
2. Laws
When you adhere to our User Agreement, you will follow the laws of your country and the laws of our business country to best experience our laws and yours. If you provide any laws that do not comply with our User Agreement, we will forcibly change the User Agreement.
3. Change of agreement
You are advised to review this User Agreement periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
We will notify you via our discord server and/or a prominent notice on our billing panel, prior to the change becoming effective.
Our services are offered on a subscription basis, with fees due at the beginning of each billing period. We reserve the right to change our fees at any time, but we will provide you with advance notice of any fee changes. If you do not pay your fees on time, we reserve the right to suspend or terminate your account.
4. ScarceHost account
By using the Site, you represent and warrant that: all registration information you submit will be true, accurate, current, and complete; you will maintain the accuracy of such information and promptly update such registration information as necessary; you are not under the age of 13 (unless with parental permission); you are not a minor in the jurisdiction in which you reside, or if a minor, you have received parental permission to use the Site; you will not access the Site through automated or non-human means, whether through a bot, script or otherwise; you will not use the Site for any illegal or unauthorised purpose; and your use of the Site will not violate any applicable law or regulation. If you provide any information that is inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of ScarceHost.
In order to use our services, you must create an account and provide us with certain information, including your name and email address. You are responsible for maintaining the confidentiality of your account login and password, and for all activities that occur under your account. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.
We may terminate, suspend, cancel or take any other action on your account at any time, for any reason, without notice. If we terminate your account, you will be required to pay any outstanding fees before your account is reinstated.
5. Cancellation of service
Your subscription will automatically renew at the end of each term, unless you cancel it. When you cancel the service, you agree that you can no longer claim a refund or continue the service. Your service may cancel immediately on requesting a cancellation and your data will not be able to be recovered.
If you comply with the refund policy, you have the right to open the support ticket to cancel the service and get a refund, however, you will no longer be able to purchase our services.
We are not responsible for the loss of data if you cancel the service, be sure to make a backup of your data before requesting a cancellation.
6. Responsibility
All services and websites are "AS IS". We do not assume any responsibility for loss, piracy or any other liability that may be. The responsibility is in your hands.
Users are responsible for the installation and maintenance of their chosen software and scripts. ScarceHost may provide tools like Softaculous for one-click installations, but ongoing updates, security, and compatibility checks remain the user's responsibility.
We reserve the right to modify or discontinue any of our services at any time, without notice. Prices for all products are subject to change. We will not be liable to you or any third party for any modification, suspension, or discontinuance of our services.
7. Prohibited actions
You are not allowed to perform prohibited actions included but not limited: to cryptocurrency mining, hacking, brute force, overloading or any other type of action that may harm customers or the ScarceHost website/services.
You are solely responsible for the content and activity on your website or online presence. You agree to use our services in compliance with all applicable laws and regulations. You may not use our services for any illegal or unauthorised purpose, or to engage in any activity that infringes the rights of others.
You must follow fair use, if your account exceeds your plan limits, we may terminate, suspend, cancel or take any other action on your account at any time, without notice. Any labels of “unlimited” also fall under this policy, all features are subject to fair use. Your use of the services must be for their intended purpose and fall under a reasonable understanding of resource usage of a typical publicly available service.
8. Payment
The Payment may include extra charges including, but not limited to, fees, VAT (Value Added Tax) or service charges. The Product Cost is the displayed cost of the Product and does not include any extra charges. The "Fee", which is 10% of the Product Cost at default, is added to all payments. The Fee, and the payment providers cut, will never be returned to the client in the event of a refund. The Fee is regarded as final.
You should not make a chargeback or request a refund on our payment gateways (eg PayPal) as it is possible to resolve the issue through our Refund Policy. You should not chargeback or request a refund on our payment gateways if you have received the promised service. Any chargeback or refund from the payment gateways will terminate your ScarceHost account and its services and you will no longer be able to recover your account or services unless you pay us the chargeback fee + the amount of the paid service + a 10% surcharge.
9. Discord Server
You must remain in the discord server (https://discord.gg/92Zfh2bf2V) if you use ScarceHost services. If you leave the server, you acknowledge that your user account will be suspended and you will no longer be able to retrieve it until you rejoin the support server and open an Unsuspension Ticket within the server. If you request unsuspension 3 times, your account may be permanently suspended.
10. Resale
You are not authorised to resell our services or claim our services as yours. If you do, your account will be terminated and you will no longer be able to use or receive our services. This clause will not apply if you use reseller packages (for example reseller VPS hosting) or approach us for permission prior to use.
11. Free Hosting Limitations
You must login to your Billing Account (https://billing.scarcehost.uk) at a minimum of once every 7 days. If you do not login to your account in 7 days, your free servers will be suspended. If it becomes 12 days since your last login to your Billing Account, your free servers will be deleted. No backups will be available and all data will be lost.
If you login after 7 days, but prior to the 12 days, your services can be unsuspended by utilising the unsupend button on the billing panel, and you will then be able to continue to use them as normal.
All orders for our Free Hosting products will be subject to manual checks before creation. You acknowledge that these checks will not be instant and may take time to be verified, particularly during any holiday seasons. By placing an order, you accept that there is a possibility of your order being declined at Our discretion. Your services may also be subject to routine checks against accounts & services which could lead to account/service termination even after initial acceptance..
Free Hosting Products are limited to one “large” and one “small” product at one time. “Large” services include minecraft and game hosting products, and “small” services include bot, voice and database hosting. Web hosting products are also limited to one per user. Attempts to bypass this policy may result in termination of your account.
No compensation will be provided for any free hosting products.
12. Downtime and maintenance
If we do any maintenance, we will aim to publish the scheduled maintenance times in our discord server, in that time you accept that we have rights to carry out maintenance up to 48 hours and we do not have the right to reimburse you if the reason for the refund was maintenance. Our services are provided "as is" and without any warranty or condition, express or implied. We do not guarantee that our services will be uninterrupted or error-free, and we will not be liable for any interruptions or errors.
13. Copyright/trademark/original notice
We are not affiliated with Mojang AB, Discord Inc or any company that owns the game or product for which we provide services.
Our official website is ScarceHost.uk. Any other website with similar or equal design, infrastructure or system is not affiliated with us! Beware of scammers claiming to be ScarceHost or using similar infrastructure to ours. If you find one, please let us know right away so we can take action.
14. Non-payment Policy
In case of non-payment, services will be suspended after 48 hours and permanently deleted 7 days after the lack of payment. Backups will not be provided upon non-payment.
A 5% late fee will be applied after 48 hours of overdue payment. Ensure to adhere to the payment schedule to avoid additional charges.
Backups will not be provided in the event of non-payment. It is the user's responsibility to ensure their data is backed up before any potential service suspension.
15. Support Ticket Policy
Support tickets inactive for 72 hours may be closed automatically. If you require further assistance, please reopen the ticket or create a new one.
16. Giveaway Redemption Limitations
ScarceHost occasionally conducts giveaways for various products and services. Users are limited to redeeming one of each type of product offered in any giveaways. Attempting to redeem multiple instances of the same product may result in disqualification from other giveaways or other appropriate actions at ScarceHost's discretion.
17. Affiliate Programme
Upon participation in the affiliate program, You expressly agree that the accrued balance, a direct outcome of affiliate activities, holds the sole purpose of serving as credit for ScarceHost services. It is explicitly clarified that such accrued credit is non-withdrawable in the form of cash.
Refund Policy
You have the right to request a refund within 48 hours of your purchase via the billing panel. You will need to provide a valid reason as to why you want a refund to be provided to you. Some of our services do not apply to the refund policy, which includes domains, dedicated IP addresses and management services (plugin setup, pterodactyl installation packages etc). We may decline your refund request if our payment gateway does not provide the refund option. If you want a refund to your PayPal, the “Fee” will not be refunded. In the event you open a Refund Request, your refund request will be processed within 5 business days and the processing time will not be included as days of services used for the Refund Policy. Once the Refund Request has been fulfilled, we have the right to prevent you from continuing to use ScarceHost to prevent future abuse.
